LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event shall the company, its managers, members, licensors, employees, agents, officers or directors be liable to you or any third-party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, loss of data, or loss of profits, whether or not we have been advised of the possibility of such damages, and on any theory of liability, arising out of or in connection with the use of the Website/and or Application or of any website referenced or linked to from our Website/and or Application. You will be responsible for all claims and damages resulting from the misuse of the Website/and or Application by you.

CANCELLATION/ REFUND POLICY

All cancellation fees held by www.thebluestories.com are only intended to cover our direct cost of amending and/or canceling your reservation/ booking. By accessing, browsing, using and/or completing a reservation through our Website/ and or Application you acknowledge and agree to have read, understood and agreed to be legally bound to the cancellation policy as set out below. No contract between the customer and www.thebluestories.com shall come into existence until www.thebluestories.com receives full payment and issues a confirmation invoice. The customer making the reservation/ booking accepts these conditions for himself and on behalf of all the members he may have book also and is responsible for payment due in entirety.

All communications relating to these terms and conditions (in particular any requests to cancel or amend your arrangements) must be from the lead customer of each reservation/ booking and processed through the portal where customer can manage their reservations/ bookings. If the customer portal is inaccessible, all cancellations must be delivered in writing via the customer contact form or via the phone contact or email contact provided below. Once delivered the amendment and/or cancellation needs to be confirmed by www.thebluestories.com before further action can be taken. If reimbursement is in order, then it shall be made in accordance with all procedures and processed as quickly as possible, and the stipulated amount will be transferred to the same credit card that was used upon reservation/ booking. Please note that we can not be responsible for delays of the delivery of the reimbursement to your account once it has been processed on our end. For activities purchased through another vendor please reach out to the vendor directly with your refund and/or cancellation request.

CANCELLATION FEES, CHARGES & REFUNDS

As we start to incur costs from the time the contract is confirmed we will apply cancellation charges as shown below from the time when written notification of the cancellation is received:

From the customer:

More than 24 hours’ notice                                   –             Full refund*

Less than 24 hours’ notice                                     –              50% refund*

1 hour before notice                                               –              No refund*      

From the operator:

Poor weather or unforeseen circumstances      –             Full refund or right to reschedule

For all reservations/ bookings operated by the Website/ and or Application, a more of 24 hours’ notice of cancellation or amendment prior to your scheduled is required for a full refund. If a cancellation is made with less than 24 hours’ notice, 50% refund is given. If a cancellation is made one hour before the reservation/ booking, no refund is given. If the reserved/ booked activity is cancelled due to poor weather or unforeseen circumstances from the operator, your reservation/ booking will be cancelled and you will be refunded or if you wish you can reschedule.

If you cancel a reservation/ booking or don’t show up, any cancellation/no-show fee or refund will depend on the Service Provider

If you think you won’t arrive on time, contact your service provider and tell them when they can expect you, so they don’t cancel your reservation/ booking. If you’re late, we are not liable for the consequences (e.g. the cancellation of your reservation/ booking or any fees the service provider may charge.)

COLLECTION OF PERSONAL DATA

Our Website and the Application collects personal data about our guests and visitors, so that we can provide an experience that is responsive to our guests’ and visitors’ needs. We endeavor to collect your personal data only with your knowledge and with your permission, if necessary. “Personal Data” are data that identify you as an individual or relate to an identifiable individual. Throughout your experience with us, we collect Personal Data in accordance with law, such as:

  • Identity Data, e.g. name, surname, passport, visa or other government-issued identification data, tax number, membership or loyalty program data

  • Health Data, e.g. as required for participation in certain activities, use of services and special service and amenity requests

HOW WE COLLECT PERSONAL DATA

  • Online Services/Website: We collect Personal Data when you communicate with us through our website, or otherwise connect with us or post to social media pages or sign up for a newsletter or participate in a survey, contest or promotional offer.
  • Through our Application: We collect personal data that you may provide by downloading and registering to our Application. Registration with us is optional. However, if you don’t register with us you may not be able to use some of the features offered by the Application. In this case you may receive tailor made offers & benefits, invitations to events, newsletters and optional participation in surveys, based on your preferences and your interests.
